WILLIAM WARGO

Will Wargo is a commercial litigator with 27 years of experience litigating complex cases in federal and state courts across the country. He has been responsible for management of aspects of litigation from initial pleadings, through trial and appeal. Will has successfully handled cases involving breach of contract, consumer class action claims under California and New York law, the federal securities law, employment discrimination claims, wage and hour claims under federal, California and New York law, partnership disputes, antitrust claims, among many other varieties of claims. He has conducted internal investigations of large companies, involving critical and sensitive matters, including interviewing employees at all levels of seniority.

Will clerked for the Honorable Stephen V. Wilson, in the United States District Court for the Central District of California.

Representative matters include:

Defended large retailer in class action regarding the company's price match policy resulting in jury verdict in favor of Sears. After class certification was denied, the plaintiff (a lawyer representing himself) elected to take his individual claim to trial.

Represented a large telecommunication company in multi-year employment discrimination class action in West Virginia resulting in favorable settlement of claims for client.

Conducted an internal investigation of a large California public health care agency, involving interviewing over twenty witnesses, including senior executives and physicians, and prepared a report of findings.

A partnership dispute involving assets worth more than $40 million in Los Angeles Superior Court, resulting in favorable settlement for client.

Represented over a dozen clients whose assets were seized by the FBI from a safety deposit box company in Beverly Hills, California, including filing suits in federal court and representing clients in negotiations with the FBI and the United States Attorney's Office.

Represented Canadian investment company in breach of contract litigation with food products company resulting in $1.5 million judgment for client, which Will successfully defendant on appeal.

After a large corporation suffered federal trial loss and jury award of significant compensatory and punitive damages in employment discrimination case, was retained to write a post-trial brief that resulted in punitive damages being stricken and large reduction in compensatory damages.

Defended estate of prominent author against negligence and other claims premised on allegations that author's diet plan caused injury to plaintiff, resulting in plaintiff's case being dismissed with prejudice.

Managed response to Second Request from Federal Trade Commission regarding sale of business by oil field services company resulting in approval of the transaction with modifications acceptable to all parties.
